Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Makaany app, the website makaany.com, and the related services, communications, and features (together, the “Service”). Operator details are set out in the Legal Notice.

Makaany is a discovery and directory platform for local and online businesses and offers that, in our understanding, are compatible with our Content and Platform Guidelines — including Halal- and Kosher-oriented criteria, where applicable. The Service is offered exclusively in Germany and Austria. Makaany is not an independent certification body.

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

For users with a Business Account, the provisions in Section 9 apply in addition. In the event of a conflict, the business-use provisions prevail for business use. Our Privacy Policy also applies.

1. Definitions

“You” / “Your” means you as a user of the Service. A user is any person who accesses or uses the Service — with or without an Account.

“We” / “Us” / “Makaany” means the operator of the Service named in the Legal Notice.

“Users in our market regions” means a person resident in Germany or Austria.

“Content” means text, images, photos, information, reviews, and other data. “Your Content” means Content you submit or transmit through the Service (e.g. reviews, photos, profile information, business suggestions, reports). “User Content” means Content submitted by users. “Makaany Content” means Content we create or provide. “Service Content” means all Content made available in connection with the Service.

“Consumer Account” means an account for private use. “Business Account” means an account for managing business profiles, ads, and other business features in the Service. “Account” means any Consumer Account or Business Account.

“Package” means a feature set provided in the Service for Business Accounts that may include an ad quota, where so provided. The details shown in the Service from time to time are decisive.

“Ad quota” means the ability included in a Package to place ads in the Service, where available.

Packages and the features included in them are currently provided free of charge; no payment obligations arise from this.

2. Changes to the Terms

We may update these Terms from time to time, in particular where required by legal, technical, or functional changes.

For material changes, we will notify you in an appropriate manner before they take effect — usually via an in-app notice, on the website, and/or by email to the address linked to your Account — generally at least 14 days in advance, unless a shorter period is required for an important reason. The date of the last update appears at the top of this page.

If you continue using the Service after the changes take effect, the amended Terms will be deemed accepted to the extent permitted by law. Where required, we will separately point out your right to object and the consequences in the change notice.

3. Use of the Service

3.1 Scope

The purpose of Makaany is to collect, display, and make discoverable business listings and offers that, in our understanding, are compatible with our Content and Platform Guidelines. Makaany is a curated discovery and directory platform — not a general, unrestricted business directory.

Through the Service, you may in particular search for and view local and online businesses and offers, read or write reviews and photos, save favorites, report Content, and — where available — as a business manage and claim profiles and use ad quotas as part of Packages (Section 10).

Makaany does not broker contracts between users and listed businesses. We do not sell the products or services of listed businesses and do not provide order, delivery, reservation, or appointment-booking services.

Makaany is not an independent Halal or Kosher certification body. Listings, categories, notices, and filters are provided for guidance based on our guidelines and do not replace your own assessment or any certification. Makaany does not guarantee that any listed offer meets individual religious or other requirements.

3.2 Listing and Display

The inclusion, approval, placement, and visibility of profiles, Content, and ads on the Service are at our dutiful discretion and depend in particular on whether, in our assessment, they are compatible with the purpose of the Service and the Content and Platform Guidelines.

There is no entitlement to inclusion, continued listing, any particular display, or any particular reach. We may reject, restrict, defer, or remove profiles, Content, and ads, in particular where, in our assessment, they are incompatible with these Terms, the Content and Platform Guidelines, or the purpose of the Service.

3.3 Eligibility

The Service is directed exclusively at persons resident in Germany or Austria.

Makaany does not knowingly collect personal data from children under 13. Access to or use of the Service by persons under 13 is not permitted. The use of Makaany is permitted exclusively to persons who are at least 18 years old.

Persons we have excluded from the Service or whose Account we have closed may not use the Service.

3.4 Permission and Risk

We permit you to use the Service in accordance with these Terms. Use is at your own responsibility, including the risk of being exposed to Content that may be incomplete, inaccurate, or unsuitable for you.

3.5 Availability

The Service may be changed, updated, interrupted, or temporarily or permanently restricted at any time without prior notice. There is no entitlement to uninterrupted or error-free availability.

3.6 Accounts

Certain features require an Account. You are responsible for keeping your login credentials confidential and for activity connected with your Account, and you must notify us promptly of any unauthorized use.

A Consumer Account is intended for private use. When creating an Account, you must provide complete and accurate information. You must not impersonate another person, create multiple accounts to circumvent rules, or transfer a Consumer Account without our consent.

Through use of the Service, you may receive communications from us (e.g. email, push notifications) where permitted by law and — where required — with your consent. You may opt out of marketing communications where that option is provided. Account-related, security-relevant, and legally required messages remain unaffected.

4. Content

4.1 Responsibility for Your Content

You alone are responsible for Your Content. You bear the risks associated with its accuracy and completeness, as well as with any personal data you disclose. You represent that Your Content originates from you or that you hold the necessary rights. You must not create the impression that Makaany endorses Your Content.

You may in particular be liable if Your Content is false, intentionally misleading, or unlawful, infringes third-party rights, or violates these Terms.

4.2 License to Us

As between you and Makaany, you retain ownership of Your Content. By submitting Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, store, reproduce, publicly display, format, and technically adapt Your Content in connection with operating, providing, improving, securing, and reasonably promoting the Service.

This license ends when you delete the Content or your Account is deleted — except to the extent we must continue storing Content for technical, legal, or security reasons, or have already reused it in non-personal or aggregated form.

4.3 Ownership of Makaany Content

Makaany Content, the technical interface, the design, the compilation and arrangement of Content, software, and aggregated rating metrics belong — to the extent permitted by law — to us or our licensors. Without express permission, you must not sell, license, reproduce, publish, or create derivative works from Makaany Content.

4.4 Advertising in the Service

We may display ads and advertising placements in the Service — including those of businesses under Packages and ad quotas — near or in connection with Content. This does not give rise to any right to compensation for you.

4.5 No Endorsement of Opinions

User Content does not necessarily reflect the views of Makaany. We are not obliged to retain copies of Your Content or make them available to you, except where required by law.

5. Content and Platform Guidelines

All profiles, offers, images, texts, reviews, ads, and other Content must comply with these guidelines. The guidelines describe the framework within which Content may appear on the Service and safeguard Makaany’s curated character.

5.1 Halal and Kosher Orientation

Makaany collects and displays business and offer listings that, in our understanding, are compatible with generally recognized Halal and Kosher principles. Assessment is made on a case-by-case basis; different religious interpretations and standards are taken into account where possible. Our assessment based on these Terms and guidelines is decisive.

5.2 Basic Criteria for Offers and Content

The following products, services, and Content must not be offered, published, or actively promoted on Makaany:

  1. Products, services, and Content that do not comply with Halal and Kosher guidelines.
  2. Intoxicating or mind-altering consumables.
  3. Content of an erotic or sexual nature.
  4. Interest-based financial products and services.
  5. Gambling, betting, and comparable offers.

We may reject or remove Content and listings if, in our assessment, they are incompatible with these principles, the other guidelines, or the purpose of the Service.

Note: Makaany provides guidance based on these guidelines and the information made available. Makaany is not an independent Halal or Kosher certification body and does not guarantee that any offer meets individual religious requirements.

5.3 Other Prohibited Content

5.4 Reviews and Photos

Reviews should be based on your own actual experiences. In particular, purchased, fabricated, or manipulated reviews, undisclosed conflicts of interest, advertising in reviews, and Content unrelated to the customer experience are not permitted.

6. Representations and Prohibited Uses

You represent that you will not use the Service for the following purposes, and will not encourage others to do so:

We are not obliged to enforce the Terms on your behalf against other users. You may report violations to us; any action taken is at our discretion.

7. Third-Party Content and Services

The Service may contain third-party Content or links to third-party offerings (e.g. maps, authentication, or storage services). We do not control such Content or services and do not adopt them as our own. Use is at your own responsibility and may be subject to additional third-party terms.

8. Suggestions and Improvements

If you send us ideas or suggestions (“Feedback”), you confirm that it does not contain confidential information of third parties. We are under no duty of confidentiality and are not obliged to implement Feedback. You grant us a royalty-free, worldwide, perpetual license to use and further develop Feedback.

9. Additional Terms for Business Accounts

This section applies in addition if you have a Business Account, create or claim a business profile, or use business features. As a business user, you are responsible for the business or offer listing and the Content displayed through it.

9.1 Authority and Information

You represent that you are authorized to act for the relevant business and to bind it to these Terms. Access and use are solely in your capacity as an authorized representative. You must provide only true, current, and non-misleading information and keep opening hours, contact details, offers, and images lawful and up to date.

9.2 Halal- and Kosher-Related Obligations

You represent that the business and the products, services, and Content displayed through the Service are compatible with the Content and Platform Guidelines — including the Halal- and Kosher-related basic criteria.

This obligation applies continuously for the duration of the listing. If your offer changes so that it is no longer compatible with the guidelines, you must update the listing without delay, notify us, or end the listing.

You must not make misleading statements about Halal or Kosher compliance. Inclusion or approval of a listing by Makaany does not constitute certification or confirmation of your statements.

9.3 Claims and Approval

Claiming existing profiles may require verification and express acceptance of these Terms. We may review, approve, or reject claims and profiles — in particular by reference to the purpose of the Service and the Content and Platform Guidelines.

Upon request, you will cooperate with a review to a reasonable extent (e.g. by providing additional information). Display of a business does not constitute a recommendation, partnership, quality guarantee, or Halal/Kosher certification by Makaany.

9.4 Ads and Advertising

Ads, advertising copy, and related images must comply with the Content and Platform Guidelines and appear in dedicated sections with a corresponding heading so they are identifiable as ads. Ads may exclusively promote the business linked to the relevant Business Account and the associated Package. Advertising for other businesses, third parties, or unassigned offers is not permitted. We may reject, pause, or remove ads if they violate these Terms or the guidelines.

9.5 Freedom of Reviews

You must not offer incentives to obtain positive reviews or to prevent, remove, or change negative reviews. You must not write reviews for your own business or competitors, or circumvent systems for review ranking or fraud detection.

Use of Packages or ad quotas does not affect the substantive permissibility of reviews and does not create any entitlement to control, remove, or influence the display of reviews.

9.6 Public Business Information

To the extent you provide or release public website Content or publicly available business information, we may display and technically adapt it within the Service as necessary.

9.7 Communications

We may contact you using the contact details on file regarding your Business Account, your business listing, and Packages or ad quotas, to the extent permitted by law.

9.8 Consequences of Violations

In the event of violations of this section or the Content and Platform Guidelines, we may in particular reject, restrict, or remove listings or ads and temporarily or permanently suspend the Business Account.

10. Packages and Advertising

Business Accounts may use Packages to access business features and — where included — ad quotas. Type, scope, duration, and availability are determined by the details shown in the Service from time to time.

We may, at our own discretion, enable, adjust, suspend, replace, or end certain Packages or feature sets for selected businesses. There is no entitlement to any particular Package, quota, duration, reach, placement, or business result.

The available Packages, ad quotas, and other business features are currently provided free of charge. No fees are charged for their use, and no payment processing is offered for these services.

Ad quotas are tied to the relevant Business Account and may not be transferred to other accounts or to third parties. They may only be used to promote the business linked to that Business Account.

Where ad quotas are provided for specific periods, unused quotas may expire at the end of the relevant period and may not be carried over or accumulated into later periods. This does not give rise to any entitlement to payment, replacement, or other compensation.

Use requires an active Business Account and compliance with these Terms and the Content and Platform Guidelines. Packages, ad quotas, and other business features may be ended, restricted, or changed upon closure of the Business Account, adjustment or discontinuation of the offering, or in the event of violations.

11. Reporting and Moderation

You may report Content via the reporting feature. We may review, remove, restrict, edit, or decline to publish User Content — in particular in cases of violations of Section 5 or other provisions of these Terms.

We may temporarily or permanently suspend Accounts where there is a violation, misuse, or a security or legal risk. We are not obliged to review all Content in advance.

Affected users may contact Support at support@makaany.com. There is no entitlement to restoration of specific Content, except where otherwise required by law.

If you are resident in the European Union, additional information and complaint rights in connection with the moderation of digital content may apply. Details will be communicated separately where required.

12. Liability

Makaany does not warrant the completeness, currency, accuracy, or suitability of User Content or of information provided by listed businesses — including statements regarding Halal or Kosher compliance. Decisions based on such information are your own responsibility. Contracts and services of listed businesses are solely their responsibility.

To the extent permitted by law, we do not owe any particular features, results, or outcomes of use.

Makaany is liable without limitation for intent and gross negligence, and for injury to life, body, or health. In cases of slight negligence, Makaany is liable only for breach of material contractual obligations, and limited to the foreseeable, typically occurring damage. Mandatory liability (in particular product liability) remains unaffected.

To the extent permitted by law, we are not liable for indirect damages, loss of profit, or loss of data that could have been avoided by reasonable data backup.

13. Termination and Account Deletion

You may stop using the Service at any time and request deletion of your Account in the app or via the Support page.

After a deletion request, we deactivate the Account. For Business Accounts, Packages and remaining ad quotas end; claimed profiles may be disconnected from the Account. Personal data is deleted or anonymized in accordance with the Privacy Policy; statutory or technical retention obligations remain unaffected.

We may suspend or terminate access where there is good cause — in particular in cases of material or repeated violations.

Provisions that by their nature are intended to survive (including liability, licenses for Content already lawfully used, and final provisions) remain in effect.

14. Final Provisions

14.1 Applicable Law

If you are resident in Germany or Austria, the law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection rules of your country of habitual residence remain unaffected.

14.2 Place of Jurisdiction

If you are a consumer, the statutory places of jurisdiction apply. Otherwise — to the extent permitted — the place of jurisdiction is the registered seat of the operator as stated in the Legal Notice.

14.3 Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14.4 Severability and Entire Agreement

If any provision is invalid, the validity of the remaining provisions remains unaffected.

These Terms — together with the Privacy Policy and the documents expressly incorporated by reference — constitute the entire agreement regarding use of the Service.
